Defenses of Trump’s Emergency Declaration Defy the Law
Each abuse builds on the next; hypocrisy builds on hypocrisy.
A national emergency declaration is an abuse of power, plain and simple. It violates the intent of the statutes and the plan language of the relevant law. Congress and the courts must check the president
So, if it's obvious that Trump had the legal right to build the wall without Congress, why hasn't he done it already? Why wasn't MAGA-world telling him to do it in January 2017? Hint: Because everyone knows the emergency declaration is baseless
Declaring a national emergency to build the wall? It's not saving our country, it's (further) wrecking our constitution
Thomas S. Kidd
"If you look at the plain language and clear intent of the relevant statutes, they do not permit Trump to defy Congress and build his wall. He knows it. Congress knows it. His own lawyers know it."
"This is an attempted abuse of the constitutional order...The only clear winner is the imperial presidency. The loser is our constitutional republic."

. There are a ton of legal problems with what Trump is aiming to do here. Probably that means he won't get away with it. But the point is, he shouldn't be doing it in 1st place and Rs shouldn't allow him to.
