The girl was drunk. The boy filmed himself penetrating her from behind. Investigators said he later shared the phone video among friends and sent a text reading, “When your first time having sex was rape.” But then Judge James Troiano said that it wasn’t.
The problem with lenient rape sentences isn’t that incarceration is a viable solution to sexual violence. The problem is that they expose a pervasive indifference to women’s suffering, and the sense that women do not have claims to justice & dignity.

A judge said a teen who sexually assaulted a girl & texted his friends "When your first time having sex was rape" deserved leniency bc he was from a "good family." He questioned if it was sexual assault, defining rape as an attack at gunpoint by strangers.
When i see a 70 y.o. judge who watches a rape on video, says it wasn't rape bc it wasn't "at gunpoint" & worries about "ruining the young man's life", I just think, what is it that you did, judge, before there were cell phones, that this reminds you of?

This is so infuriating. A 16 yo boy filmed himself raping a girl & called it rape, yet a judge questioned whether it was rape bc it didn’t involve a gun (neither did either rape I experienced) & said he deserved leniency bc he was from a good family. WTF.
He added, “the victim should have been told that pressing charges would destroy the accused’s life.” No one told her that her lifetime trauma doesn’t matter. She is a body existing to facilitate - and never obstruct - the pleasure and ascendence of men.

Every once in awhile you come across a headline that stops you in your tracks.
It's not just that privileged boys' "good futures" are overrated. It's that girls' pain, humiliation, welfare, dignity, their entire humanity, don't even register. That is the root problem.
1. So. This case. The judge approached this case horrifically, but for reasons far more complicated than how it is generally being framed. His attitude towards the victim was disgusting. His attitude towards the defendant bad as well. But. But.

I came from a "good family" too, is my dad for chrissakes. Not taking advantage of a drunk woman was considered common moral sense, as was basic empathy for any woman you wanted to take to bed. So this crap can go to hell.
